Is Compliance Required?

 

If you’ve ever received a request from the assessor’s office for documents, then you know the wording in the request may sound like you’re required to supply the information.

However, that’s just simply not true in all instances.

 

Understanding When Compliance is Beneficial

 

Assessors are required by law to assess property with the best information they can practicably obtain.

However, you’re not required by law to supply that information. Granted, you’ll be helping them do their job, but will you be helping yourself?

Knowing when to supply the requested information is something we can help you with, as part of your overall tax strategy.

When do assessors usually make their requests?

Typically, assessors make requests for two reasons. The first reason is when properties are bought and sold on the market. The second reason is for municipal revaluations.

Why do assessors need this information from me?

The law requires assessors to base their assessed values on the best information they can practibaly obtain, and use acceptable appraisal practice. This means that they need to know as much as they can about the physical, and economic characteristics, of every property.

Is it my civic duty to hand all requested information over to the assessor?

In short, the answer is no. There is no law requiring citizens of Wisconsin to supply the assessor with the information they request to help them derive an assessed value.

However, in some instances, it can be beneficial to submit the requested information.

Can I still file an appeal if I don't supply the requested information?

In short, the answer is yes. However, in Wisconsin, the law states that you cannot file an appeal of your assessment based on certain information that was not supplied to the assessor. So, if they requested that information, and you choose not too supply it, you will have to supply it in order to appeal.

This is a reasonable course of action if supplying the information could facillitate a value reduction with the assessor, and if you’re confident that it can overcome the assessor’s presumtion of correctness at the Board of Review and beyond.

What does the fee for compliance cover?

The fee covers the time it takes to gather and analyze the information, and if beneficial to you, supplyy that information to the assessor as your representantive.

Will this process help with future appeals?

Having your initial, analyzed information on hand, will provide a solid basis for the appeal and speed up the process no matter when it takes place.
